What is the procedure for giving a power of attorney for a property in India?

 The power of attorney (POA) execution is quite different for NRIs and Indian residents.

Let me start with NRIs resident:

NRIs don’t have to be present physically for registration of property for buying, selling, or renting in India.

NRIs can issue true and lawful power of attorney in favor of his/her family member, relative, friend, colleague, or agent. we should make sure that attorney holder is truthful and reliable to you.

Steps to execute a power of attorney agreement as below,

Step 1: Prepare the draft in word format

Step 2: Print draft on A4 size bond paper

Step 3: NRI should sign POA in front of the Consulate Officer of the country where you are located. Should sign at bottom of all pages and witness has to sign at witness section. Get the POA attested from consulate office.

Step 4: Courier the POA to your true and lawful attorney to India.

Step 5: Attorney holder and one witness in India should sign and adjudicate the POA in India. Adjudicate at the nearest district register office

Please be noted, as a NRI, your presence is not at all mandatory to register the property but attestation from Indian consulate at your country is very much mandatory.


For Indian residents: (Both executant and attorney living at same place in India)

Here is the step by step procedure for giving power of attorney

Step 1: Prepare the draft in word format.

Step 2: Print customized draft on stamp paper, A stamp value of Rs. 200 is sufficient for karnataka location. Purchase stamp paper at any cooperative bank nearby or get it franked at sub-register office.

Step 3: Executant and attorney must sign POA at bottom of all pages, Witness has to sign at witness section of the agreement.

Step 4: Register the POA at nearest sub-register office


For Indian residents: (executant or attorney living at different places in India)

Step 1: Executant should prepare the draft in word format

Step 2: Print the draft on stamp paper. Rs. 200 stamp value is sufficient for Karnataka location or get it franked in sub-register office

Step 3: Executant should sign the POA and register the POA at nearest sub-register office

Step 4: Executant should send the POA to attorney (through courier or hand delivery)
