How can I check online if a property in Bangalore is under litigation?

 Yes, there are few options to check online if a property in Bangalore under litigation

Option 1: RTC

RTC stands for record of rights, tenancy, and corp information. In simple terms, Its a land record.

RTC contains the details of landowner’s name, survey number, type of land, measurement, nature of possession (agricultural or commercial or residential)

If any litigation in property, stay order number mentioned in RTC report. In the below-attached image, one such report we have come across recently. This RTC report has stay order. we circled the stay order number in below image for your information.

Download the RTC report trough Bhoomi online service. It cost Rs. 10/- to download a report. You need survey number to download a report.

Option 2: Encumbrance certificate:

An encumbrance certificate is popularly known as EC. An EC is issued by sub-register office of revenue department. We can download the EC online through Kaveri online service. It cost Rs. 15/- to download online.

Unlike RTC report, EC is applicable for both land and building. RTC is applicable only to land.

Generally, an EC is issued in 2 types.

  1. Form 15
  2. Form 16

Form 15 is issued when the property has any encumbrance of a court case, mortgage or partition disputes, etc..

Form 16 is issued when the property doesn’t have any encumbrance. Also, know as NIL ENCUMBRANCE. Having a clear marketing title to sell.

Option 3: Khata certificate:

Khata certificate is applicable to both land and building. A property that doesn’t comply with BBMP regulation is not obliged to receive khata certificate. Especially deviation from building approval plan, safety issue, and build on agriculture land

To improve property tax collection, BBMP issue only Form B extract to illegal property but not the khata certificate.

So I mean, the legally qualified property should have khata certificate and extract. whereas deviated property won’t have khata certificate.
